- THIS IS THE LAST WILL and Testament of me John Pennock of Limberhill in the Township of Egton in the County of York Yeoman First I give unto my dear Wife Hannah Pennock one full half part or share of all my Household furniture plate and linen Also I give and devise unto my son Jonathan Pennock his heirs and assigns all that my messange and homestead with the several closes inclosures pieces or parcels or Land and hereditennants thereto belonging and therewith now occupied as a Farm by my said son Jonathan Pennock and commonly called or known by the name of Thorneywhate Farm and situate or being in the Township or precints of Glazedale in the said County of York and also all and all manner of tythes whatsoever issuing winning or coming from or out of the said Farm and premises together with all the rights members and appurtenances thereunto belonging To hold the same Farm tythes and premises unto and to the use of my said son Jonathan Pennock his heirs and assigns forever subject and and chargeable nevertheless and I do hereby charge the same with the payment of one not annual or clear annual Seven pounds of lawful money of Great Britain unto my daughter Mary Gatenby the wife of William Gatenby for and during the term of her natural life by equal half … portions on the sixth day of April and the Eleventh day of October in every year the first payment thereof to be made on such of the said days as shall next happen after my decease And … and divert that the same annuity to my daughter Mary shall from time to time be paid into her own hands and that her receipt alone shall be a sufficient … for the same to the and the same annuity may not be subject to the debts or contracts of her present or after taken Husband And on the death of my said daughter Mary I also change the same farm and premises with the payment of the legacy or sum of one hundred and fifty pounds unto and equally amongst all the children of her my said daughter Mary and their respectively attaining the age of twenty one years And I also charge the said Farm and premises with the payment of a legacy of one hundred pounds to my Granddaughter Hannah Parker to be paid to her when she attains the age of twenty one years And I direct that the said legacy shall bear and pay interest at the rate of three per cent until the said legacy be paid and that such interest shall be applied towards the maintenance and education of my said Granddaughter until she attains the age of twenty one years old Also I give and device unto my son Robert Pennock his heires and assigns all that my mesonage and homestead and also all the closes inclosures and hereditaments thereto belonging and therewith now accutried as a Farm by Elizabeth Ling as my Tenant commonly called or known by the name of Rake Farm and situate and being in the Township of Glazedale aforesaid and also all and all manner of tythes whatsoever issuing arising or coming from or out of the same Farm and premises together with all the rights members and appurtenances thereto belonging To holdall the said farm hereditaments and premises with their appurtenances unto my said son Robert Pennock his heirs and assigns To the use of such person or persons and for such estate or estates and in such parts shares or proportions manner or form and either with or without power of revocation and new appointment as my said son Robert Pennock shall by deed or Will direct limitation appoint and in default of such direction limitation or appointment or until any such shall be made and as o such estate or interest as shall not be directed limited or appointed to the use of my said son Robert Pennock and his assigns for and during the term of his natural life without innpeaehment of waste and from and after the determination of the estate by an means in his lifetime To the use of my friend Thomas Yeoman of Limerhill aforesaid Farmer his executors and administrators during the natural life of my said son Robert Pennock upon trust nevertheless for the only benefit of my said son Robert Pennock and his assigns and to the end and intent that the present and every future wife of my said son Robert Pennock may be barred and precluded from all estate right and title of or to dower in or out of the same premises or any part thereof and from and immediately after the determination of the Estate hereby limited in use of the said Thomas Yeoman his executors and administrators during the life of my said son Robert Pennock then to the use of my said son Robert Pennock his heirs and assigns for ever subject and chargeable nevertheless and do hereby charge the same Farm and premises called Rake Farm with the payment of one net annuity or clear annual sum of Twenty pounds of lawful money of Great Britain unto my said dear Wife Hannah Pennock and her assigns for and during the term of her natural life by equal half yearly payments to be made within seven days next after my decease and to be considered as due such commencing at my death And I also charge the same Farm and premises called Rake Farm with the payment of one net annuity or clear annual sum of Seven pounds of lawful money of Great Britain unto my daughter Susannah Autus the wife of John Autus for and during the term of her natural life by equal half yearly portions on the sixth day of April and the Eleventh day of October in every year the first payment thereof to be made on such of the said days as shall next happen after my decease and I order and direct that the same annuity to my daughter Susannah Autus shall from time to time be paid into her own hands and that her receipt alone shall be a sufficient discharge for the same to the end of the same annuity may not be subject to the debts or contracts of her present or any after taken husband and on the death of my said daughter Susannah also charge the same Farm and premises with the payment of the legacies or sum of one hundred and fifty pounds unto the child or children of my said daughter Susannah on their respectively attaining the age of twenty one years share and share alike And I also charge the same Farm and premises called Rake Farm with the legacy or sum of Four hundred pounds unto my son James Pennock to be paid to him at the end of twelve calendar months next after my decease And I also charge the same Farm with the following legacies or sums of money that is to say unto my son Thomas Pennock the sum of one hundred and fifty pounds and unto my son William Pennock the sum of fifty pounds unto my daughter Elizabeth Ling Ling widow of the late John Ling the sum of Fifty pounds unto my son John Pennock the sum of fifty pounds Unto my daughter Hannah Yeoman the wife of Robert Yeoman the sum of one hundred an fifty pounds Unto my daughter Ann Mead the wife of Richard Mead the sum of one hundred and fifty pounds and unto my Grandson John Gatenby and unto my Granddaughter Ann Wood (the children of my daughter Elizabeth) the sum of five pounds apiece all which legacies I direct to be paid at the end of twelve months next after my decease I give and bequeath unto my son William Pennock all my Tenant right and interest in Limberhill Farm and all the … Cattle Sheep and other stock together with all the Carriages implements of husbandry geer Corn Hay and all other stock crops and following Crops on the said Farm or usually accufried therewith and to which I may have a right or be entitled at the time of my decease and also one half part or share of all my Household furniture plate and linen Also I give and devise unto my son John Pennock his heirs and assigns for ever all that my messuage or dwellinghouse with the orchard and appurtenances thereto belonging situate in Glazedale aforesaid and now in the occupation of Thomas Peirson as my Tenant And I give and bequeath unto my said son Robert Pennock all the residue of my goods chattels and personal estate and effects whatsoever and wheresoever and not hereinbefore otherwise disposed of subject and chargeable nevertheless and I do hereby charge all my real and personal estates hereby given to my said son Robert Pennock with the payment of all my just debts funeral and testamentary expences and also with the costs charges and expences attending the execution of this my Will and I appoint my said sons Robert Pennock and Jonathan Pennock joint Executors f this my Will And lastly I do hereby declare that the provision hereby made for my said Wife is intended to be and shall be accepted by her in lieu of her dower or thirds out of all my real estates In Witness whereof I have hereunto set my hand this Tenth day of February in the year of our Lord one thousand eight hundred and thirty.
